Retail Leases / Rental Advice From time to time a retail lease will come to the market review phase, where agreement between the parties about the new rent can be achieved a new lease can period can be entered into by both parties. However from time to time, the parties to a lease can disagree, at CMA we have considerable expertise in retail real estate and we are able to provide advice to both landlords and tenants about current rental market movements and provide a qualified and well researched opinion as to the current market rental of the property. We would point out that should the matter have to be sent onto determination, a small disagreement in what is considered to be market rental could become a very expensive exercise.
Rental Submissions Where a lease has entered a market review phase and parties cannot agree to the rental proposed for the new term of the lease, both landlords and tenants require representation from a qualified property professional in order to fairly document and advise on the market rental. Where a matter has reached a stalemate most leases will direct the matter to determination by a valuer as appointed by either the API or REIV. In order to represent your interests as either a landlord and/or tenant in this process a well researched and qualified rental submission should be prepared for consideration by the determining valuer.
